This withdrawal policy applies to contracts you conclude with me as a consumer by distance communication (e.g. e-mail, telephone or the contact form on this website) or away from my business premises (e.g. at your location).
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). Businesses within the meaning of § 14 BGB have no statutory right of withdrawal.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days
- for contracts for the supply of services, from the day of the conclusion of the contract;
- for contracts for the supply of goods, from the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the goods. If you ordered several goods in one order that are delivered separately, the period starts on the day you or a third party indicated by you acquires physical possession of the last item.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
Additionally, for services
If you requested that the performance of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Additionally, for the supply of goods
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Early expiry of the right of withdrawal when work starts immediately
For a contract for the supply of services, your right of withdrawal expires early once we have fully performed the service, provided that we only began performing it after you gave your express consent and at the same time acknowledged that you would lose your right of withdrawal upon full performance of the contract (§ 356 (4) BGB).
If, at your request, work is to begin before the withdrawal period has expired, we obtain the following declaration from you before starting — as a confirmation by e-mail, a ticked box in the quotation, or a signature on the order form:
I expressly request that Martin Scholz (Echuir Tech) begin performing the
commissioned service before the withdrawal period has expired.
I am aware that I lose my right of withdrawal once the service has been fully
performed by Martin Scholz (Echuir Tech).
I am further aware that, if I withdraw before full performance, I must pay
proportionate compensation for the services already provided up to that point.
Place, date, name
Where such a contract is concluded away from business premises (e.g. at your location), your consent must be provided to us on a durable medium — an e-mail or an order form signed by you is sufficient.
Without this declaration, we will not begin performing until the withdrawal period has expired.
Further exceptions to the right of withdrawal
Under § 312g (2) BGB, there is no right of withdrawal for contracts, among others,
- for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by you is decisive, or that are clearly tailored to your personal requirements (no. 1) — this applies in particular to computers individually configured and built for you;
- for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if they were unsealed after delivery (no. 3);
- for the supply of sealed audio or video recordings or computer software, if they were unsealed after delivery (no. 6);
- where you have specifically requested a visit from us in order to carry out urgent repairs or maintenance (no. 11). Your right of withdrawal remains in place for any additional services rendered during that visit which you did not expressly request, and for any goods supplied during the visit other than spare parts necessarily used for the maintenance or repair.
For contracts for the supply of digital content not supplied on a tangible medium, your right of withdrawal expires in accordance with § 356 (5) BGB once we have begun performing the contract after you gave your express consent and acknowledged the loss of your right of withdrawal.
